PREAMBLE

These general terms and conditions of sale apply between:

The company HOME DECORATION (Trade Name: MIS EN DEMEURE), a SAS with a capital of 1,970,200 euros, having its registered office at 27 rue du Cherche Midi – 75006 Paris – FRANCE, registered in the Paris Trade and Companies Register under number 453 615 767, NAF code 4759B, VAT number FR72453615767, publisher of the website www.misendemeure.com Hereinafter referred to as: "MIS EN DEMEURE" And: Any person making a purchase on the website www.misendemeure.com

Hereinafter referred to as: "The CLIENT"

The CLIENT declares to have the capacity to conclude this contract, i.e. to be of legal age and not under guardianship.

I - ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

MIS EN DEMEURE reserves the right to adapt or modify these General Terms and Conditions of Sale "GTC" at any time.

The version of the GTC applicable to any online sale on the website www.misendemeure.com, any sale through the Customer Service, as well as any sale in one of our points of sale.

Consequently, placing an Order implies prior, irrevocable, and unreserved adherence by the Client to these GTC.

II – DURATION

These GTC apply during the entire period of online availability of products and services offered by MIS EN DEMEURE.

III – REGISTRATIONS ON THE SITE

A) INDIVIDUAL CLIENTS

The Client can register on the site by creating an "Individual" account.

By registering on the Site, the Client declares and guarantees to MIS EN DEMEURE that they are of legal age and have the legal capacity to contract.

MIS EN DEMEURE may delete the Client's account at any time, for any reason, at its sole discretion.

B) PROFESSIONAL CLIENTS

To place an Order, the professional Client must first register on the site by creating a "Professional" account.

After verifying the information, the Client will receive a confirmation email of the registration.

A Professional Client refers to those engaged in a Decorating, Architecture, Reseller business, or in the Hotel industry.

It is important to note that to benefit from the discounts reserved for professional clients, a minimum order of 2,500€ is required for all orders placed through our website, sales service, or store.

IV – ORDER THROUGH CUSTOMER SERVICE

The Client can order one or more Products directly through Customer Service at the following email addresses home.decoration@misendemeure.com or contact@misendemeure.com or by phone.

All Orders must be confirmed in writing by the Client and include the references and characteristics of the desired Products, as well as their personal information for order execution purposes.

Placing an Order implies the Client's full acceptance of these General Terms and Conditions of Sale. The Client acknowledges having read them at the time of ordering and accepts them without reservation.

V – PRODUCTS AND SERVICES

Products refer to all items or services listed on the website www.misendemeure.com "the Products".

The Products offered for sale are described and presented as accurately as possible. However, if any errors or omissions have occurred in this presentation, MIS EN DEMEURE cannot be held liable.

The photos representing our Products are for illustrative purposes only. These photos, as well as the texts illustrating the products, do not form part of the contractual scope.

VI – ORDERS

The Client may select as many Products as they wish, which will be added to their cart. This cart summarizes the Products selected by the Client as well as the associated prices and fees. The Client may freely modify the Cart before validating it as an Order. Validation of the Order confirms the Client's acceptance of the GTC, the purchased Products, their prices, and the associated fees.

An email summarizing the Order will be sent to the Client by MIS EN DEMEURE. In this regard, the Client formally accepts the use of email for confirmation of their Order. Invoices are available in the "my account" section of the Site.

VII – ORDERING METHODS – CONFIRMATION

Once the Order is validated by the Client in accordance with the terms of Article VI, a confirmation email, acknowledging receipt of the Order and summarizing all the information, is sent by Mis en Demeure to the Client as soon as possible.

The Order will only be considered final once Mis en Demeure has sent the Client a confirmation email or purchase order, and the sale of the Product(s) will only be finalized upon receipt of payment by the Client or, if applicable, the requested deposit from the Client.

Any modification of the Order after confirmation is subject to the acceptance of Mis en Demeure.

The unavailability, either temporary or permanent, of a Product shall not, under any circumstances, engage the responsibility of Mis en Demeure and entitle the Client to any form of compensation.

VIII – PRICES AND PAYMENT TERMS

The prices of the products and services presented on the Site are indicated in Euros, all taxes included (TTC). They are applicable at the time of Order validation by the Client and do not include transportation costs, which are billed in addition and indicated on the "DELIVERY" page of the cart before final validation of the order. All-inclusive prices are VAT-inclusive for products delivered within the European Union. Articles subject to VAT are taxed under French VAT law. Any changes in French VAT rates will be reflected in the price of the products and services presented on the Site, as stipulated by the application decree.

In the event of manifest errors in the displayed price, MIS EN DEMEURE reserves the right to cancel the Order. Payments already made will be refunded immediately.

The prices of the Products or Offers proposed on the Site are binding only on the Site itself, and in no case on partner stores or showrooms, which are free to offer the Products at a different price.

Lamps, unless otherwise indicated on the product sheet, are sold without lampshades.

Payment in 3 installments

MIS EN DEMEURE offers its Clients the Alma credit service for the settlement of their purchases and the execution of the payment. This is subject to the Client's acceptance of Alma's terms and conditions or credit agreement.

Any refusal to grant credit by Alma for an order may result in its cancellation.

Termination of the GTC binding the Client and MIS EN DEMEURE will result in the termination of the terms and conditions or credit agreement between Alma and the Client.

Payment in three installments is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Purchase amounts:
Only purchases between €350 and €2,000 are eligible for payment with Alma.

Fees:
When paying in 3 installments with Alma, the Client does not pay any fees.

Alma is a telepayment manager and issues an electronic certificate that will serve as proof of the amount and date of the transaction in accordance with Articles 1316 and following of the Civil Code.

Termination:
Any termination of the GTC binding the Seller and the Client results in the termination of the terms and conditions between Alma and the Client.

IX – INVOICE

The invoice is sent to the email address provided at the time of the order and is also available in the "My Account" section of the site. It is issued in accordance with the tariff in force on the day the order is placed. MIS EN DEMEURE disclaims any responsibility for input errors.

X – DELIVERY

The delivery times indicated on the Site are for information purposes and may not be respected in the following cases:

  • Exceptional activity peak (sales period, etc.)
  • Public holiday in France
  • Failure to receive the CLIENT's payment on time
  • Anti-fraud verification procedure for the CLIENT's order

Shipments are then handled by a transportation service provider, which ensures delivery to the address indicated by the CLIENT.

Orders placed on the Site can only be shipped to the destinations offered. For any request for international shipping, please contact us at contact@misendemeure.com.

The delivery times indicated on our website are provided by transportation service providers and are for informational purposes only. Exceeding these deadlines cannot be held against MIS EN DEMEURE, nor can it give rise to the cancellation of the contract or any compensation for damages.

The transport risks are borne by the CLIENT from the moment the goods leave the warehouse. The CLIENT is required to check the condition of the goods at the time of delivery and to notify the carrier of any damage or missing items in the delivery slip, followed by sending the latter a formal notice by registered mail with acknowledgment of receipt within three (3) days.

To report any issues, the CLIENT must contact MIS EN DEMEURE customer service within three (3) days.

XI – REFUNDS

Refunds will be made within thirty (30) days of receipt of the returned items, subject to compliance with the return conditions.

The refund will be credited to the CLIENT's bank account corresponding to the payment method used for the order.

Any return request outside the return period will not be accepted.

XII – WARRANTY

All products purchased from MIS EN DEMEURE are covered by the legal guarantees of conformity and hidden defects provided for in Articles L.217-4 and following of the Consumer Code and in Article 1641 of the Civil Code. Consequently, the CLIENT has the right to return products delivered that are defective or non-compliant.
